European Commission issued its implementing decision on standard contractual clauses (SCCs)

On June 4, 2021, the European Commission issued its implementing decision on standard contractual clauses (SCCs) for the transfer of personal data from the European Union to “third countries” such as the United States pursuant to Regulation (EU) 2016/679 (European Commission Decision (EU) 2021/914). For parties who entered into data processing agreements including the previous version of the SCCs, the Commission has advised that the parties must replace the old SCCs with the new version of the SCCs by December 31, 2022 at the latest.
